the owner of an arcade here gave us (from now onward referral to "us"=me and my friends) permission to mess up with IIDX empress content (as he did before for gold, troopers and ITG). we just ripped out the hd at first, then we saw a lot of videos with removed songs back and we'd like to put back some good songs lost in time, plus some cs and originals (read SHIKI official bms')

now the problem is... HOW?

for public display in a commercial setting it typically would be, but I'm pretty sure it wouldn't be provided the songs were legally owned and it was in a private setting (home, etc)

The only circumstance in which I can imagine this wouldn't be illegal is if you only put BMS songs that you owned the copyrights to (i.e., public domain, used with permission, or songs that you wrote yourself). Otherwise you're putting up BMSes to songs that you don't have the legal rights to distribute. In a home setting nobody would really care, but if you're putting this in arcade machine that the arcade will be charging money for people to play, it can potentially get dangerous.

ITG only streamed the data off of the USB card - I'm pretty sure hacking the songs onto the machine would still be of questionable legality. The streaming version means that you're paying to play YOUR songs, of which they have no control over (whether you legally own the song or not is of no concern to them, since you're just using the machine to play it, like you would on any other media player), while putting the songs on the hard drive means you'd have to have the rights to distribute it (since others will be paying to play your song).

I've only taken one course in digital copyright law, and it's been a few years, so I'm certainly lacking in knowledge and a little rusty, but it hardly sounds legal.

Not like having a IIDX machine here is legal, anyway, though! So I doubt that would be a big issue for Konami if you put songs on there, since you're not supposed to have the game in the first place.

There's an arcade in Reno that has custom BMS files on a troopers machine or some ish...you should get in contact with them...

ITG was pretty gray-area too, I think they just put in the custom songs thing because they knew they were going down anyway, and didn't really care. Plus the fact that you're hacking Konami's copyrighted software, DMCA and all that. But yeah, ask Kenchan.

The DMCA is a section of US copyright law well-known for its provisions regarding copy protection circumvention and Internet takedown notices. Seeing as how you're in Italy, and it doesn't involve hosting things on US servers, it probably doesn't apply, but the EUCD might.

It's funny how illegal it is to hack songs onto an itg machine for regular play but nobody cares and it's become a standard. nobody would probably care if you did it on IIDX or whatever.

but it's still illegal! ;/

It is grey area - if you use legally free songs, public domain music, or music you got permission from the rightsholder or artist [not always one in the same], for example, I'm sure it'd be legal from a standpoint of the music being used.
